NOTICE OF MORTGAGE FORECLOSURE Default having been made in the terms and conditions of a certain Mortgage in the principal amount of $40,000.00 by and between 100 E. SEAWAY, LLC, a Michigan limited liability company, whose address is 5017 Division Avenue South, Wyoming, Michigan 49548, as Mortgagor, and K HIGGINS PROPERTIES, LLC, a Michigan limited liability company, whose address is 3907 E. Apple Avenue, Muskegon, Michigan 49442 as Mortgagee, dated February 18, 2025, and recorded in Liber 4384, Page 483, Muskegon County Register of Deeds, concerning property at 100 E. Seaway Drive, Muskegon Heights, Michigan 49444, together with all proceeds, easements, appurtenances, rents, and licenses now or later pertaining or issuing and all buildings, improvements, and fixtures now or later situated on the real property, because of non-payment of installments and/or interest and non-payment of real property taxes. The amount due under the mortgage as of the date of this notice is $15,000.00, principle and accrued interest, with interest continuing to accrue at the rate of 0.00%. No suit or proceedings at law or in equity have been instituted to recover the debt secured by said mortgage or sale contained in said mortgage or any part thereof. Now, therefore, by virtue of the power of sale contained in said mortgage, and pursuant to the statute of the State of Michigan in such case made and provided, notice is hereby given that on Friday, March 20, 2026, at 11:00 a.m. said mortgage will be foreclosed by a sale at public auction, to the highest bidder at the Pine Street entrance to the Michael E. Kobza Hall of Justice Building in Muskegon, MI. Under MCL 600.3240(7), the length of time that the property may be redeemed by the Mortgagor is six months after the date of sale, or Monday, September 21, 2026. Should said real property be sold, the Mortgagor will be held responsible to the purchaser of said property for any damage to said property during the redemption period. The description of the property being foreclosed on is located in the City of Muskegon Heights, County of Muskegon, State of Michigan, and is legally described as follows: That part of Government Lot 4, Section 8, Town 9 North, Range 16 West, described as follows: Commencing at the Northwest corner of said Section; thence South 87 degrees 56 minutes East, along the North line of said Government Lot, 695.52 feet for point of beginning, thence South 301.32 feet to a point 30 feet North of the North line of Seaway Drive (I-96 BR and US-31 BR); thence South 89 degrees 16 minutes East, parallel to said North line, 180 feet; thence North 297.12 feet to a point on the North line of said Government Lot 4, which is 454.88 feet West of the Northeast Corner of said Government Lot 4; thence North 87 degrees 56 minutes West, along said North line, 180.10 feet to the point of beginning.
